2. Scope
These Terms of Sale apply to the acquisition of works offered by Lansdown Arts, including finished architectural dollhouses, aviaries, decorative birdcages, architectural works and individually commissioned pieces.
Any special terms stated in a quotation, commission agreement, invoice or order confirmation form part of the contract and take precedence over these general terms where they differ.
3. Nature of the works
Lansdown Arts creates individual, handmade works. Variations arising from handwork, traditional finishes, aged surfaces, reclaimed materials and the artistic process are part of each work’s character and are not defects.
Measurements, colours and photographs are provided as accurately as possible. Screen settings, lighting and photography may cause minor differences in appearance.
Unless expressly identified otherwise, the works are collectible decorative objects and are not toys or products intended for unsupervised use by children.
4. Availability and enquiries
Submitting an enquiry does not create an order or reserve a work.
Because many works are unique, availability must be confirmed personally by the studio. A work is reserved only when Lansdown Arts issues written confirmation and receives any payment or deposit specified in the quotation.
If a work is no longer available before an order is confirmed, Lansdown Arts will inform the customer and no contract will be formed.
5. Quotations and formation of the contract
Before purchase, the customer will receive a written quotation, order summary or invoice identifying, as applicable:
• the work and its essential characteristics;
• its price and applicable taxes;
• packing and delivery charges;
• the proposed delivery method;
• the estimated delivery date or period;
• the payment schedule;
• any estimated return cost for a work that cannot normally be returned by post; and
• any special conditions relating to a commission or international delivery.
The customer may review and correct the information before accepting it.
The contract is formed when the customer expressly accepts the quotation or order summary and Lansdown Arts receives the payment or deposit required to confirm the order. Written confirmation will be provided by email or another durable medium.
Quotations remain valid for the period stated on the quotation.
6. Prices and taxes
Prices are stated in euros.
Prices communicated to consumers include applicable VAT unless expressly stated otherwise. Packing, delivery, insurance, installation, customs duties and other charges are included only when identified in the quotation or order confirmation.
For deliveries outside the European Union, the recipient may be responsible for import duties, taxes, brokerage charges or local fees unless the quotation expressly states that they are included.
7. Payment
Payment terms and accepted payment methods will be stated in the quotation, invoice or secure payment request.
Payment may be requested in full for a finished work. Commissions may require a deposit and staged payments according to the schedule stated in the commission agreement.
A customer should never send payment using instructions received from an unexpected or unverified address. If there is any doubt, contact the studio using the contact details published on lansdownartsfrance.com.
Lansdown Arts retains ownership of a work until all amounts due for that work, including agreed delivery charges, have been paid in full.
8. Commissions and personalized works
The scope, dimensions, materials, artistic direction, price, payment schedule and estimated completion period for a commission will be set out in a separate written quotation or commission agreement.
The customer is responsible for reviewing and approving the specifications before work begins. Changes requested after approval may affect the price and completion date and require a revised quotation.
Artistic decisions remain subject to the maker’s judgement within the agreed concept. Because commissioned works are handmade, reasonable artistic and material variations may occur.
Where a work is made to the customer’s specifications or is clearly personalized, the statutory right of withdrawal does not apply in accordance with Article L221-28 of the French Consumer Code. The customer will be asked to acknowledge this before confirming the commission.
9. Delivery
Each work requires individual packing and delivery planning. The method, destination, cost and estimated delivery date or period will be confirmed before the order is finalized.
Lansdown Arts will deliver within the date or period stated in the order confirmation. If no date or period has been agreed, delivery will take place without undue delay and no later than the period required by applicable law.
The customer must provide complete and accurate access and delivery information, including any stairs, narrow entrances, lifting requirements or other conditions relevant to safe delivery.
Additional costs caused by inaccurate information, an unsuccessful delivery attempt or special handling not disclosed before confirmation may be charged to the customer where legally permitted.
For consumer sales, the risk of loss or damage transfers when the customer, or a person designated by the customer other than the carrier, takes physical possession of the work. If the customer independently appoints a carrier not proposed by Lansdown Arts, risk may transfer when the work is handed to that carrier, as provided by law.
10. Inspection and transport damage
Customers are encouraged to inspect the packaging and work at delivery. If damage is visible, describe it on the carrier’s delivery record where possible, photograph the packaging and work, retain all packing materials and contact Lansdown Arts promptly.
Failure to record an immediate reservation does not remove any rights the customer may have under mandatory consumer law or the legal guarantee of conformity.
11. Right of withdrawal for ready-made works purchased at a distance
A consumer purchasing a ready-made work through a distance contract generally has fourteen days from physical receipt of the work to withdraw without providing a reason.
To exercise this right, the consumer must send the withdrawal form below, or another unambiguous statement expressing the decision to withdraw, before the fourteen-day period expires.
The work must then be returned no later than fourteen days after the withdrawal notice is sent.
The consumer is responsible for the direct cost of return unless Lansdown Arts agrees otherwise or failed to provide the legally required cost information. Because many works cannot normally be returned by post, the applicable quotation or order confirmation will provide an estimate of the return transportation cost before purchase.
The customer must take reasonable care of the work and package it appropriately for return. The customer may be responsible for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and condition of the work.
Lansdown Arts will refund eligible payments, including the cost of the least expensive standard delivery method offered for the original order, within fourteen days after receiving the withdrawal notice. Lansdown Arts may withhold reimbursement until the returned work is received or the customer provides evidence that it has been dispatched, whichever occurs first.
Refunds will ordinarily be made through the original payment method unless otherwise agreed.
12. Exceptions to withdrawal
The statutory right of withdrawal does not apply to works made to the customer’s specifications or clearly personalized.
It also does not ordinarily apply to a purchase contract concluded in person at a fair or exhibition where the seller is conducting business, subject to applicable law.
These exceptions do not affect the customer’s rights concerning damage, non-conformity or hidden defects.

14. Returns
No work should be returned without first contacting Lansdown Arts so that suitable handling, packing, insurance and transport arrangements can be discussed.

15. Legal guarantees
Consumers benefit from the mandatory legal guarantee of conformity and the legal guarantee against hidden defects.
Under the legal guarantee of conformity, the seller is responsible for qualifying defects in conformity existing when the work is delivered. The consumer may exercise this guarantee within two years of delivery, subject to the conditions of Articles L217-3 and following of the French Consumer Code.
The legal guarantee against hidden defects applies under Articles 1641 and following of the French Civil Code. The customer may choose to return the work for a refund or retain it and obtain an appropriate reduction in price, subject to the applicable legal conditions. An action based on a hidden defect must generally be brought within two years after discovery of the defect.
These legal guarantees apply independently of any optional commercial guarantee.

16. Intellectual property
The purchase of a work transfers ownership of the physical object only. Copyright, design rights, reproduction rights and other intellectual-property rights remain with Eric Lansdown, Lansdown Arts or the relevant rights holder unless expressly transferred in writing.
The customer may not commercially reproduce, manufacture, license or exploit the design of a work without prior written permission.

Personal information is processed in accordance with the Lansdown Arts Privacy Policy, available on the website.

19. Consumer mediation
After first submitting a written complaint to Lansdown Arts, a consumer may refer an unresolved dispute free of charge to the consumer mediator appointed by the business:

20. Governing law
These Terms of Sale and contracts entered into with Lansdown Arts are governed by French law.
For consumers residing outside France, this choice does not remove any mandatory protection granted by the law of the consumer’s country of residence.
The parties will first attempt to resolve any dispute amicably. Nothing in these Terms restricts a consumer’s right to use any court having jurisdiction under applicable consumer law.
21. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply.
22. Language
These Terms are written in English for the customers of Lansdown Arts. A French version may also be made available. If translated versions differ, mandatory consumer protections remain unaffected.
